The right to freedom of information: ensuring access
to historical documents

Parliamentary Assembly

1. The Assembly refers to its Resolution 2535 (2024) «The right to freedom of information: ensuring access to historical documents» and invites the Committee of Ministers to:

1.1. adopt a recommendation to member States of the Council of Europe in order to advance access to historical documents specifically. The recommendation should focus on:

1.1.1. the general principles that underpin access to information and how they affect historical documents in law and practice;

1.1.2. the conditions of access to historical documents by historians, researchers, academics, non-governmental organisations (NGOs) and the public at large;

1.1.3. procedures for requesting access to historical documents and their overall accessibility in practice;

1.1.4. oversight and review mechanisms, and the remedies available in the event of nondisclosure of historical documents by State authorities;

1.1.5. the need to support remembrance projects and initiatives;

1.1.6. the need for greater international collaboration in sharing historical information;

1.2. promote the signature and ratification of the Council of Europe Convention on Access to Official Documents (CETS No. 205) in order to advance access to documents held by public authorities more generally.

Le droit à la liberté d'information: garantir l'accès aux
documents historiques

Assemblée parlementaire

1. L'Assemblée renvoie à sa Résolution 2535 (2024) «Le droit à la liberté d'information: garantir l'accès aux documents historiques» et invite le Comité des Ministres:

1.1. à adopter une recommandation à l'intention des États membres du Conseil de l'Europe afin de faire progresser spécifiquement l'accès aux documents historiques. La recommandation devrait porter sur les points suivants:

1.1.1. les principes généraux qui sous-tendent l'accès à l'information et la manière dont ils affectent les documents historiques en droit et en pratique;

1.1.2. les conditions d'accès aux documents historiques pour les historiens, les chercheurs, les universitaires, les organisations non gouvernementales (ONG) et le grand public;

1.1.3. les procédures de demande d'accès aux documents historiques et leur accessibilité globale dans la pratique;

1.1.4. les mécanismes de contrôle et d'examen, et les recours disponibles en cas de nondivulgation de documents historiques par les autorités de l'État;

1.1.5. la nécessité de soutenir les projets et les initiatives de mémoire;

1.1.6. la nécessité d'une plus grande collaboration internationale dans l'échange d'information historique;

1.2. à promouvoir la signature et la ratification de la Convention du Conseil de l'Europe sur l'accès aux documents publics (STCE n^o 205) afin de faire progresser l'accès aux documents publics de manière plus générale.

Il diritto alla libertà di informazione: assicurare l'accesso
ai documenti storici

Assemblea parlamentare

1. L'Assemblea fa riferimento alla Risoluzione 2535 (2024) «Il diritto alla libertà di informazione: garantire l'accesso ai documenti storici» e invita il Comitato dei Ministri a:

1.1 adottare una raccomandazione rivolta agli Stati membri del Consiglio d'Europa per promuovere l'accesso ai documenti storici. La raccomandazione dovrebbe concentrarsi su:

1.1.1 i principi generali che sono alla base dell'accesso all'informazione e il modo in cui essi riguardano i documenti storici nel diritto e nella prassi;

1.1.2 le condizioni di accesso ai documenti storici da parte di storici, ricercatori, accademici, ONG e grande pubblico in generale;

1.1.3 le procedure di richiesta di accesso ai documenti storici e la loro accessibilità complessiva nella pratica;

1.1.4 meccanismi di controllo e revisione e strumenti di ricorso disponibili in caso di mancata divulgazione di documenti storici da parte delle autorità statali;

1.1.5 la necessità di sostenere progetti e iniziative sulla memoria;

1.1.6 la necessità di una maggiore collaborazione internazionale nella condivisione delle informazioni storiche;

1.2 promuovere la firma e la ratifica della Convenzione del Consiglio d'Europa sull'accesso ai documenti ufficiali (STCE n. 205) al fine di promuovere l'accesso ai documenti detenuti delle autorità pubbliche in generale.
