Rights and obligations of NGOs assisting refugees and migrants in Europe

Parliamentary Assembly,

1. Recalling its Resolution 2356 (2020) «Rights and obligations of NGOs assisting refugees and migrants in Europe», the Parliamentary Assembly emphasises the importance of NGOs for member States in assisting refugees and migrants.
2. Referring to the European Convention on the Recognition of the Legal Personality of International Non- Governmental Organisations (ETS No. 124), the Recommendation CM/Rec(2007)14 of the Committee of Ministers on the legal status of non-governmental organisations in Europe, the Joint Guidelines on Freedom of Association adopted by the European Commission for Democracy through Law (Venice Commission) and the Office for Democratic Institutions and Human Rights of the Organization for Security and Co-operation in Europe (OSCE/ODIHR) and the Guidelines on Protecting NGO Work in Support of Refugees and Other Migrants prepared by the Expert Council on NGO Law of the Conference of INGOs of the Council of Europe, the Assembly recommends that the Committee of Ministers prepare common standards for facilitating the international work of NGOs providing humanitarian assistance for migrants, refugees and displaced persons. Particular attention should be given to facilitating:

2.1. the establishment of local field offices,

2.2. entry visas and residence permits for NGOs’ staff members,

2.3. the transport and distribution of humanitarian goods,

2.4. the provision of humanitarian services by NGOs’ staff members,

2.5. the recognition of professional qualifications of NGOs’ staff members, such as medical qualifications,

2.6. international bank transfers of funds for humanitarian action,

2.7. tax privileges for international and national donations and their humanitarian use.

3. Referring to the Charter on the Rights and Responsibilities of Volunteers of the European Youth Forum, the Assembly recommends that the Committee of Ministers develop legally binding standards for volunteers, with due regard to the European Social Charter (ETS Nos. 35 and 163).

Droits et obligations des ONG venant en aide aux réfugiés et aux migrants en Europe

Assemblée parlementaire,

1. Rappelant sa Résolution 2356 (2020) «Droits et obligations des ONG venant en aide aux réfugiés et aux migrants en Europe», l'Assemblée parlementaire souligne l'importance des ONG pour les États membres dans l'aide apportée aux réfugiés et aux migrants.
2. Se référant à la Convention européenne sur la reconnaissance de la personnalité juridique des organisations internationales non gouvernementales (STE no 124), à la Recommandation CM/Rec(2007)14 du Comité des Ministres sur le statut juridique des organisations non gouvernementales en Europe, aux Lignes directrices conjointes de la Commission européenne pour la démocratie par le droit («Commission de Venise») et du Bureau des institutions démocratiques et des droits de l'homme de l'Organisation pour la sécurité et la coopération en Europe (OSCE/BIDDH) sur la liberté d'association et aux Grandes lignes sur la protection du travail des ONG en faveur des réfugiés et autres migrants établies par le Conseil d'experts sur le droit en matière d'ONG de la Conférence des OING du Conseil de l'Europe, l'Assemblée recommande au Comité des Ministres d'élaborer des normes communes pour faciliter les activités internationales des ONG qui apportent une aide humanitaire aux migrants, aux réfugiés et aux personnes déplacées. Il conviendrait de veiller tout particulièrement à faciliter:

2.1. la création de bureaux de terrain au niveau local;

2.2. l'obtention de visas d'entrée et de permis de séjour pour le personnel des ONG;

2.3. le transport et la distribution des biens humanitaires;

2.4. la fourniture de services humanitaires par le personnel des ONG;

2.5. la reconnaissance des qualifications professionnelles du personnel des ONG, s'agissant par exemple de leurs compétences médicales;

2.6. les virements bancaires internationaux de fonds destinés à l'action humanitaire;

2.7. les avantages fiscaux appliqués aux dons nationaux et internationaux et à leur utilisation à des fins humanitaires.

3. Se référant à la Charte européenne sur les droits et les responsabilités des bénévoles, mise au point par le Forum européen de la jeunesse, l'Assemblée recommande au Comité des Ministres d'élaborer des normes juridiquement contraignantes pour les bénévoles, en tenant dûment compte de la Charte sociale européenne (STE nos 35 et 163).

Diritti e obblighi delle ONG che assistono i profughi e i migranti in Europa

Assemblea parlamentare,

1. Richiamando la sua Risoluzione …. (2020) «Diritti e obblighi delle ONG che assistono i profughi e i migranti in Europa», l'Assemblea parlamentare sottolinea l'importanza delle ONG per gli Stati membri nell'assistenza fornita a profughi e migranti.
2. Facendo riferimento alla Convenzione europea sul riconoscimento della personalità giuridica alle organizzazioni internazionali non governative (STE n. 124) e alla Raccomandazione CM/Rec(2007)14 del Comitato dei Ministri sullo status giuridico delle organizzazioni non governative in Europa, l'Assemblea raccomanda al Comitato dei Ministri di elaborare norme comuni per agevolare le attività internazionali delle ONG che forniscono assistenza umanitaria ai migranti, ai profughi e agli sfollati. Più specificamente, è opportuno facilitare:

2.1. la creazione di uffici locali sul campo;

2.2. il rilascio di visti d'ingresso e permessi di soggiorno per il personale delle ONG;

2.3. il trasporto e la distribuzione di beni umanitari;

2.4. l'erogazione di servizi umanitari da parte del personale delle ONG;

2.5. il riconoscimento delle qualifiche professionali del personale delle ONG, ad esempio le qualifiche medico-sanitarie;

2.6. i bonifici internazionali di fondi destinati all'azione umanitaria;

2.7. l'introduzione di agevolazioni fiscali per le donazioni internazionali e nazionali e il loro utilizzo a scopi umanitari.

3. Facendo riferimento alla Carta europea dei diritti e delle responsabilità dei volontari del Forum europeo della gioventù, l'Assemblea raccomanda al Comitato dei Ministri di mettere a punto norme giuridicamente vincolanti per i volontari, nel debito rispetto della Carta sociale europea (STE nn. 35 e 163).
