The principles and guarantees of advocates

Parliamentary Assembly,

1. The Parliamentary Assembly refers to its Resolution 2348 (2020) «The principles and guarantees of advocates».
2. The Assembly welcomes the Committee of Ministers’ constructive initial response to its call in Recommendation 2121 (2018) «The case for drafting a European convention on the profession of lawyer» and takes note of the ongoing work of the European Committee on Legal Co-operation on its feasibility.
3. The Assembly reiterates its call on the Committee of Ministers to proceed with the drafting and adoption of a legally-binding instrument as a priority and reiterates the call made in its Recommendation 2121 (2018) to establish a platform for the protection of advocates from any interference with the exercise of their professional activities.
4. The Assembly reminds the Committee of Ministers of the need for legislative provision of fair trial rights, by creating conditions of equality between prosecution and defence in adversarial proceedings, as well as guaranteeing the safety of advocates, along with other participants in judicial proceedings (including judges, investigators and prosecutors), in the exercise of their professional activities.

Les principes et garanties applicables aux avocats

Assemblée parlementaire,

1. L'Assemblée parlementaire se réfère à sa Résolution 2348 (2020) «Les principes et garanties applicables aux avocats».
2. L'Assemblée se félicite de la réponse initiale constructive du Comité des Ministres à l'appel qu'elle a lancé dans sa Recommandation 2121 (2018) «Pour une convention européenne sur la profession d'avocat» et prend note des travaux en cours du Comité européen de coopération juridique sur sa faisabilité.
3. L'Assemblée rappelle qu'elle a invité le Comité des Ministres à procéder en priorité à la rédaction et à l'adoption d'un instrument juridiquement contraignant et réitère l'appel qu'elle avait lancé dans sa Recommandation 2121 (2018) en faveur de la création d'une plate-forme de protection des avocats contre toute ingérence dans l'exercice de leurs activités professionnelles.
4. L'Assemblée rappelle au Comité des Ministres la nécessité de prévoir, par voie législative, le droit à un procès équitable, en créant les conditions d’égalité entre l'accusation et la défense dans les procédures contradictoires, ainsi qu'en garantissant la sécurité des avocats et celle des autres participants aux procédures judiciaires (y compris les juges, les enquêteurs et les procureurs) dans l'exercice de leurs activités professionnelles.

RACCOMANDAZIONE 2188

Principi e garanzie applicabili all'avvocatura

Assemblea parlamentare,

1. L'Assemblea parlamentare fa riferimento alla Risoluzione... (2020) «Principi e garanzie applicabili all'avvocatura».
2. L'Assemblea si congratula dell'iniziale risposta costruttiva del Comitato dei Ministri all'appello lanciato nella Raccomandazione 2121 (2018) «Per una Convenzione europea sulla professione forense» e prende nota dei lavori in corso nel Comitato europeo di cooperazione giuridica sulla sua fattibilità.
3. L'Assemblea ricorda di aver invitato il Comitato dei Ministri a procedere in via prioritaria alla redazione e adozione di uno strumento giuridicamente vincolante e reitera l'appello formulato nella Raccomandazione 2121 (2018) in favore della creazione di una piattaforma per proteggere l'avvocatura da qualsiasi ingerenza nell'esercizio delle attività professionali.
4. L'Assemblea ricorda al Comitato dei Ministri la necessità di prevedere, per via legislativa, il diritto a un equo processo, creando condizioni di parità tra l'accusa e la difesa nei procedimenti in contradditorio, nonché garantendo la sicurezza degli avvocati e degli altri partecipanti ai procedimenti giudiziari (compresi i giudici, gli investigatori e i procuratori) nell'esercizio delle rispettive attività professionali.
