Missing refugee and migrant children in Europe

Parliamentary Assembly,

1. Referring to its Resolution 2324 (2020) on missing refugee and migrant children in Europe, the Parliamentary Assembly emphasises the importance of preventing child refugees and migrants from going missing and of doing everything possible to find children who have gone missing, in order to avoid them falling victim of violence, abuse, human trafficking and organ trafficking.
2. While the Council of Europe does not have specific action for missing refugee and migrant children, some of its bodies and instruments may be of added value in preventing the disappearance of these children. Therefore, the Assembly recommends that the Committee of Ministers:
2.1. invite the States parties to the Convention on Action against Trafficking in Human Beings (CETS No. 197) and the States parties to the Convention for the protection of children against sexual exploitation and sexual abuse (CETS No. 201) to share national experiences in prevention of the disappearance of child refugees and migrants in the context of human trafficking or sexual exploitation;
2.2. invite the States parties to the European Convention on Mutual Assistance in Criminal Matters (ETS No. 30) to consider coordinated strategies for mutual assistance and the exchange of information concerning missing refugee and migrant children as well as unidentified dead children, for instance by making use of the Interpol Yellow and Black Notices and the Schengen Information System;
2.3. recognising the work of the Congress of Local and Regional Authorities, especially its Resolution 428 and Recommendation 414 (2018) on unaccompanied refugee children: the role and responsibilities of local and regional authorities, encourage the Congress to continue addressing this issue as well as that of migrant street children as set out in Congress Resolution 271 (2008) on the social Pag. 3reintegration of children living and/or working on the streets, especially in relation to measures to prevent children going missing;
2.4. invite the Steering Committee for the Rights of the Child (CDENF) to examine policies to prevent the disappearance of migrant children in the context of its work on guardianship and its review of Recommendation CM/Rec(2007)9 of the Committee of Ministers to member States on life projects for unaccompanied migrant minors.

3. Recognising the concrete action to protect children fleeing war, violence and persecution carried out in the framework of the Council of Europe Action Plan on Protecting Refugee and Migrant Children in Europe (2017-2019), the Assembly commends the special focus given by the plan to unaccompanied children. It therefore asks the Committee of Ministers to give high priority to the evaluation and follow-up to the Action Plan, and to support the promotion and use of the tools developed in its framework. Renewed priority should be given to this area, to ensure continuity with the work already achieved.

Disparitions d'enfants réfugiés ou migrants en Europe

Assemblée parlementaire,

1. Se référant à sa Résolution 2324 (2020) sur les disparitions d'enfants réfugiés ou migrants en Europe, l'Assemblée parlementaire souligne l'intérêt d'empêcher les disparitions d'enfants réfugiés ou migrants et de faire tout ce qui est possible pour retrouver les enfants disparus afin de leur éviter de se retrouver victimes de violences, d'abus, de la traite d’êtres humains ou du trafic d'organes.
2. Bien que le Conseil de l'Europe ne mène pas d'action spécifique en faveur des enfants réfugiés ou migrants disparus, certains de ses organes et instruments peuvent apporter une valeur ajoutée pour prévenir la disparition de ces enfants. Par conséquent, l'Assemblée recommande au Comité des Ministres:
2.1. d'inviter les États parties à la Convention du Conseil de l'Europe sur la lutte contre la traite des êtres humains (STCE n° 197) et les États parties à la Convention du Conseil de l'Europe sur la protection des enfants contre l'exploitation et les abus sexuels (STCE n° 201) à partager leurs expériences nationales en matière de prévention des disparitions d'enfants réfugiés ou migrants dans un contexte de traite des êtres humains ou d'exploitation sexuelle;
2.2. d'inviter les États parties à la Convention européenne d'entraide judiciaire en matière pénale (STE n° 30) à réfléchir à des stratégies coordonnées d'entraide et d’échange d'informations sur les enfants réfugiés ou migrants disparus ainsi que sur les enfants décédés non identifiés, par exemple en ayant recours aux notices jaunes et noires d'Interpol et au Système d'information Schengen;
2.3. reconnaissant les travaux du Congrès des pouvoirs locaux et régionaux, en particulier ses Résolution 428 et Recommandation 414 (2018) «Enfants réfugiés non accompagnés: rôle et responsabilités des collectivités locales», d'encourager le Congrès à continuer de traiter cette question ainsi que celle des enfants migrants vivant dans la rue, conformément à sa Résolution 271 (2008) «La réinsertion sociale des enfants vivant et/ou travaillant dans la rue», en particulier pour ce qui est des mesures de prévention des disparitions d'enfants;Pag. 5
2.4. d'inviter le Comité directeur pour les droits de l'enfant (CDENF) à examiner les protocoles de prévention de disparition d'enfants migrants dans le contexte de ses travaux sur la tutelle et de son examen de la Recommandation CM/Rec(2007)9 du Comité des Ministres aux États membres sur les projets de vie en faveur des mineurs migrants non accompagnés.

3. Reconnaissant l'action concrète de protection des enfants fuyant la guerre, la violence et les persécutions, réalisée dans le cadre du Plan d'Action pour la Protection des Réfugiés et des Enfants Migrants du Conseil de l'Europe (2017-2019), l'Assemblée se félicite de l'attention spéciale portée par le plan aux enfants non accompagnés. Elle demande par conséquent au Comité des Ministres d'accorder une grande priorité à l’évaluation et au suivi de ce plan d'action, et de soutenir la promotion et l'utilisation des outils mis au point dans le cadre de cette initiative. En outre, il conviendra de renouveler la priorité donnée à cette question, afin d'assurer la continuité des actions déjà menées.

Minori rifugiati e migranti scomparsi in Europa

Assemblea parlamentare,

1. Facendo riferimento alla Risoluzione ... (2020) sui Minori rifugiati e migranti scomparsi in Europa, l'Assemblea parlamentare sottolinea l'importanza di prevenire la scomparsa di bambini rifugiati o migranti e di fare il possibile per ritrovare quelli scomparsi, così da evitare che siano vittime di violenza, abusi, tratta degli esseri umani e traffico di organi.
2. Anche se il Consiglio d'Europa non prevede un'azione specifica per i bambini migranti e rifugiati scomparsi, alcuni suoi organi e strumenti possono offrire valore aggiunto nella prevenzione della scomparsa di questi bambini. Di conseguenza, l'Assemblea raccomanda al Comitato dei Ministri di:
2.1. invitare gli Stati parte della Convenzione sulla lotta contro la tratta degli esseri umani (STCE n. 197) e gli Stati parte della Convenzione per la protezione dei bambini contro lo sfruttamento e gli abusi sessuali (STCE n. 201) a condividere esperienze nazionali nella prevenzione della scomparsa di bambini migranti e rifugiati nel quadro della tratta degli esseri umani e dello sfruttamento sessuale;
2.2. invitare gli Stati parte della Convenzione europea di assistenza giudiziaria in materia penale (STE n. 30) a valutare strategie coordinate di assistenza reciproca e scambio di informazioni sui bambini migranti e rifugiati scomparsi e sui bambini deceduti non identificati, ad esempio utilizzando le notifiche gialle e nere di Interpol e il Sistema di informazione di Schengen;
2.3. riconoscendo il lavoro svolto dal Congresso delle Autorità Locali e Regionali, in particolare nella Risoluzione 428 e nella Raccomandazione 414 (2018) su “Bambini rifugiati non accompagnati: ruolo e responsabilità delle autorità locali e regionali”, incoraggia il Congresso a continuare ad affrontare questo fenomeno e quello dei bambini migranti che vivono per strada, come previsto nella Risoluzione 271 (2008) del Congresso sul reinserimento sociale di bambini che vivono e/o lavorano per strada, soprattutto in relazione alle misure di prevenzione della loro scomparsa;
2.4. invitare il Comitato ad hoc per i diritti dell'infanzia (CAHENF) ad esaminare politiche per prevenire la scomparsa di bambini migranti nel quadro del suo lavoro sulla tutela e della revisione della Raccomandazione CM/Rec(2007)9 del Comitato dei Ministri agli Stati membri sui progetti di vita in favore dei minori migranti non accompagnati.

3. Riconoscendo l'azione concreta per proteggere i bambini che fuggono dalla guerra, la violenza e le persecuzioni, realizzata nel quadro del Piano di Azione del Consiglio d'Europa per la protezione dei bambini migranti e rifugiati in Europe (2017-2019), l'Assemblea raccomanda di prestare particolare attenzione nel Piano ai minori non accompagnati. Chiede quindi al Comitato dei Ministri di attribuire la massima priorità alla valutazione e ai seguiti del Piano di azione e sostenere la promozione e l'uso di strumenti sviluppati in questo contesto. Dovrebbe essere rinnovata la priorità attribuita a questo settore, così da assicurare continuità con i risultati già realizzati.
