Family reunification of refugees and migrants in the Council of Europe member States

Parliamentary Assembly,

1. Referring to its Resolution 2243 (2018), the Parliamentary Assembly emphasises the importance of protecting family life under Article 8 of the European Convention on Human Rights (ETS No. 5) and recommends that the Committee of Ministers:
1.1. draw up guidelines for the application of the right to family reunification of refugees and migrants as well as for mutual legal assistance and administrative co-operation between member States and with third countries in this field;
1.2. invite member States to establish bilateral arrangements so they can represent each other when receiving visa applications and issuing visas;
1.3. invite the member States that have not yet done so to join, or co-operate with, the European Union Schengen Visa Information System with a view to exchanging the data necessary for enabling family reunification;
1.4. co-operate with the International Committee of the Red Cross in promoting mechanisms and action for finding missing family members of refugees, in co-operation with national Red Cross and Red Crescent societies and national parliaments;
1.5. reinforce Council of Europe action on combating trafficking of child refugees, ensuring that unaccompanied child refugees are reunited with their parents, unless this is against the best interests of a child, for example if parents have participated in the trafficking of this child.

Regroupement familial des réfugiés et des migrants dans les États membres du Conseil de l'Europe

Assemblée parlementaire,

1. Se référant à sa Résolution 2243 (2018), l'Assemblée parlementaire souligne l'importance de protéger la vie familiale en vertu de l'article 8 de la Convention européenne des droits de l'homme (STE no 5) et recommande que le Comité des Ministres:
1.1. élabore des lignes directrices pour l'application du droit au regroupement familial des réfugiés et des migrants, et pour une entraide judiciaire et une coopération administrative entre les États membres et avec les pays tiers dans ce domaine;
1.2. invite les États membres à conclure des accords bilatéraux afin de pouvoir se représenter mutuellement pour recevoir des demandes de visas et en délivrer;
1.3. invite les États membres qui ne l'ont pas encore fait à adhérer au Système d'information sur les visas de l'Espace Schengen de l'Union européenne ou à coopérer avec lui afin d’échanger les données nécessaires pour des regroupements familiaux;
1.4. coopère avec le Comité international de la Croix-Rouge dans la promotion des mécanismes et des initiatives de recherche des membres disparus des familles de réfugiés, en collaboration avec les sociétés nationales de la Croix-Rouge et du Croissant-Rouge ainsi que les parlements nationaux;
1.5. renforce la lutte du Conseil de l'Europe contre la traite d'enfants réfugiés pour que les enfants réfugiés non accompagnés puissent rejoindre leurs parents, à moins que ce ne soit contraire à l'intérêt supérieur d'un enfant, par exemple quand les parents ont été impliqués dans la traite de cet enfant.

Il ricongiungimento familiare negli Stati membri del Consiglio d'Europa

Assemblea parlamentare,

1. Facendo riferimento alla propria Risoluzione ... (2018), l'Assemblea parlamentare sottolinea l'importanza della protezione della vita familiare ai sensi dell'articolo 8 della Convenzione europea dei diritti dell'uomo (STE n. 5) e raccomanda che il Comitato dei ministri:
1.1. elabori linee guida per l'applicazione del diritto al ricongiungimento familiare di profughi e migranti, nonché per l'assistenza giudiziaria reciproca e la cooperazione amministrativa tra gli Stati membri e con i paesi terzi in questo campo;
1.2. inviti gli Stati membri a stabilire accordi bilaterali per rappresentarsi a vicenda ai fini della raccolta delle richieste e del rilascio dei visti;
1.3. inviti gli Stati membri che non l'abbiano ancora fatto ad aderire o a cooperare con il Sistema di Informazione Visti dello spazio Schengen dell'Unione europea allo scopo di scambiare i dati necessari per consentire un più rapido ricongiungimento familiare;
1.4. cooperi con il Comitato internazionale della Croce rossa nella promozione di meccanismi e iniziative per la ricerca dei familiari dispersi dei profughi, in collaborazione con le società nazionali della Croce rossa e della Mezzaluna rossa e con i parlamenti nazionali;
1.5. rafforzi l'azione del Consiglio d'Europa nella lotta contro il traffico di profughi minorenni, assicurandosi che i minori non accompagnati si ricongiungano con i loro genitori, a meno che ciò non sia contrario all'interesse superiore del minore per esempio ove i genitori siano implicati nella tratta di questo minore.
